CTP Mastermind: Dutch WHOA as an International Turnaround Tool!

 
The Dutch landscape for financial restructuring has changed since the new Dutch Scheme (WHOA). 
 

This relatively new law, in force since 2021, has become the backdrop of many debt restructurings and the driver of international proceedings with a Dutch company. 

Join us on Tuesday 12th November 2024 for EACTP’s Mastermind Webinar where Richelle Ros of Kruger, Marcel Windt and Mark Mouthaan of Windt Le Grand Leeuwenburgh will guide you through the practical legal basics and business issues of the WHOA.

They will discuss how the WHOA addresses typical restructuring issues, such as valuation, refinancing, and shareholder involvement, as well as its novel features, including the 'strong' moratorium and the roles of the restructuring officer and observer. 

Additionally, they will compare the WHOA with the English Restructuring Plan.

About the speakers:

Richelle Ros, Restructuring consultant | Partner, Kruger

Richelle Ros specialises in business/ financial restructuring and distressed M&A. She is very well experienced in the business economics aspects of the Dutch Scheme, e.g. post-restructuring viability assessment and valuations.

Marcel Windt, Attorney-at-law | Partner, Windt Le Grand Leeuwenburgh

Marcel Windt specialises in insolvency law and financial restructuring. He serves both as a court-appointed bankruptcy trustee, as a liquidator, (silent) receiver, pre-pack administrator, restructuring expert under the Dutch Scheme and as a restructuring advisor to companies and creditors.

Currently, he is appointed Chairman of the Steinhoff Recovery Foundation, the entity that distributes the Steinhoff Global Settlement.

Mark Mouthaan, Attorney-at-law | Counsel, Windt Le Grand Leeuwenburgh

Mark Mouthaan specialises in restructuring and finance. Since the enactment of the Dutch Scheme (WHOA) in 2021, he advised debtors, creditors, shareholders and officeholders on more than ten WHOA proceedings.
